General Terms and Conditions of Sale (GTC)

Article 1: Purpose and Scope

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between the École Spécialisée en Data, Management & Intelligence Artificielle (ESDMIA) (hereinafter "the School") and any student or their legal representative (hereinafter "the Client") enrolling in a long-term program (Bac+4/Bac+5) or an intensive bootcamp. The validation of the application and the payment of tuition fees imply unreserved acceptance of these GTC, which prevail over any other document and serve as a study contract.

Article 2: Admission, Enrollment and Minimum Cohort Sizes

Enrollment is only final after:

• Acceptance of the application file by the admission committee.
• Payment of enrollment fees or the first tuition installment.
• Provision of all required supporting documents (Identity, diplomas, applicable visas).

Minimum enrollment and course organization: The official opening of a cohort or class for degree programs (Bac+4 / Bac+5) is subject to a minimum quota of 5 enrolled students. To ensure optimal group dynamics and educational continuity, the Executive Management of ESDMIA reserves the right to adapt class organization at any time, including the combination or sharing of common course modules between Bac+4 and Bac+5 cohorts.

The School reserves the right to cancel an enrollment in the event of fraud or falsification of documents.

Article 3: Pricing and Payment Terms

Program prices are indicated in euros (€) net of taxes (VAT exemption for higher education). The Client may choose:

• A one-time payment before the start of the program (giving right to a potential discount).
• Installment payments (via SEPA direct debit) according to the schedule agreed upon during enrollment.

Any default in payment will result in late penalties and may suspend access to classes and the School's AI platforms.

Article 4: Right of Withdrawal and Cancellation

Right of Withdrawal (Distance selling): In accordance with Article L221-18 of the French Consumer Code, the Client has a period of 14 days from the online validation of their enrollment to exercise their right of withdrawal, without having to justify reasons or pay penalties.

Cancellation before the start of the academic year: Outside the legal period, any cancellation less than 30 days before the start of the program will result in the retention of administrative fees.

Withdrawal during the program: Any started quarter is due in its entirety. In the event of force majeure (serious illness, visa refusal), a pro-rata refund may be considered upon presentation of supporting documents.

Article 5: Intellectual Property

All course materials, AI prompts, access to private LLMs, videos, and educational documents provided to the Client remain the exclusive intellectual property of ESDMIA and its professors. Any external commercial reproduction or distribution is strictly prohibited and subject to prosecution.

Article 6: Applicable Law and Disputes

These GTC are subject to French law. In the event of a dispute, and after an attempt at amicable mediation, the competent courts within the jurisdiction of the Paris Court of Appeal shall have exclusive jurisdiction.
